Germany Negative Leave Rule

According to Article 5 paragraph 3 of the Federal Leave Act (BUrlG), it is not permitted to reclaim excess leave taken. Hence, we need to ensure that leave balance for German employees are checked every month at the beginning of the month.

 

(3) If, in the case referred to in subsection (1)(c), the employee has already received leave in excess of the amount to which he is entitled, the leave pay paid in respect thereof may not be reclaimed.
