Severance requirement in Switzerland

An employee is only entitled to severance if they have at least 20 years of service with the employer and are, at the same time, at least 50 years of age. (339 (b) of the Code).

The severance is then between 2 and 8 months' compensation (339 (c)).

However, the employer can deduct statutory pension contributions paid during the employment from this amount, and thus, in practice, the statutory severance is typically zero (339 (d)).
