UK - hourly paid/irregular hours employees - PH and Leave entitlement

Public holidays in the UK are included in the total statutory amount. This is generally described as “5.6 weeks” or “28 days”. The entitlement to this is the same for irregular hour worker as fixed hour, regular employees.

In case of irregulars hours leave should be calculated by using the following formula:

Entitlement: 260 working days - 28 holiday days entitlement = 232 working days. 28 days is therefore 28 / 232 = 12.07%.

After April 2024: Calculation formula remains the same – with regulations simply explicitly defining the pay that may be paid (you don’t have to) as 12.07% - as per WRT reg 16A(2) – this applies to workers on irregular hours, such as the Coca Cola individual in question (WTR reg 15B)
