Annual Leave Entitlment and Rules - Paraguay

Entitlement to vacation leave commences after one complete year of service with the employer. The duration of holidays leave is determined as follows:

 

  • Up to 5 years of service: 12 consecutive business days.
  • Between 5 and 10 years of service: 18 consecutive business days.
  • More than 10 years of service: 30 consecutive business days.
  • Holidays leave must begin on a Monday or the next business day if Monday is a holiday
  • Must be granted within six months after the worker becomes entitled to it.
  • Employers must notify workers at least 15 business days before the vacation period.
  • Workers must notify their employer with the same advance notice if they request vacation leave.
  • The notification must be formalized in writing for the employer and employee
  • They must be taken in the current holiday year unless by mutual agreement. 

There is no need to take all of the leave at the one time, these can be split into segments as agreed by the parties but should not be shorter than 6 consecutive days.
