Belgium - employment rules

  1. XML does not operate as a temporary worker agency in Belgium. This is due to commercial limitations – so we operate in Belgium as an “outsourced service provider”.
  2. Fixed Term Contracts (FTCs) rules: you are limited to 4 FTCs, each FTC must be for a minimum of 3 months, with a maximum total consecutive duration of 2 years.
  3. Benefits that are required are mandated by a Commission Paritaire/CLA (collective agreement).
  4. Because of #1 – we are not under the CBA for temporary agency workers, but instead the Commission Paritaire 200 (JC 200 in English) – based on what is found in find in our corporate documents.
  5. JC 200 collective agreement is attached for reference.
  6. Transportation allowance is that it depends on the mode of transportation and distance – see Article 3 of the attached.
  7. Meal vouchers: do not seem to be included as a mandatory requirement in JC 200. That being said, previously with clients in Belgium and meal vouchers are incredibly common.
  8. Salary indexation: very important to note this as it is determined by the CLA – currently set at 3.58%. XML cannot opt out of this.
  9. 13th salary and annual bonus are payable. The annual bonus is 250 EUR (pro-rata, see 2.2.2.1 of JC 200)
